Agreement to terms

These Terms & Conditions ("Terms") govern your use of www.clemmonstreeservice.com (the "Site") and the tree services provided by Clemmons Tree Service ("we," "us," or "our"), an owner-operated tree service based in Cullman, Alabama.

By visiting the Site, requesting a quote, or hiring us to perform work, you agree to these Terms. If you don't agree, please don't use the Site or our services.

What we offer

We provide residential and commercial tree services in Cullman and the surrounding areas, including:

  • Tree removal — technical takedowns, storm response, and hazard tree work.
  • Tree pruning — crown cleaning, thinning, raising, and reduction performed to ANSI A300 standards.
  • Stump grinding — below-grade grinding for replanting, sodding, or hardscaping.

We do not perform chemical treatments, primary power-line work, or landscaping/planting services. Anything outside the scope of our quote falls outside this agreement.

Estimates and quotes

Estimates are free, given in person, and come with no obligation. The quoted price is the price you pay as long as the scope of work we agreed to doesn't change. If we encounter a condition no one could have seen from the ground — a hollow trunk, hidden split, buried debris — we will pause and talk through any change before continuing.

Quotes given over the phone or from a photo are rough ranges only. A binding price is given only after we walk the job in person.

Scheduling and weather

We schedule jobs around weather and crew availability. Lightning, high wind, and hard rain can force us to reschedule. We will tell you as early as possible and book the next available slot.

Emergency response — a tree on a structure, a tree blocking access, or active hazards after a storm — moves to the front of the schedule. Call us as soon as it's safe to.

Payment terms

Unless we've agreed in writing otherwise, payment is due upon completion of the work. We accept check, cash, and major credit cards.

For larger commercial or multi-day projects we may request a small deposit to hold the schedule. Any deposit terms are disclosed in writing before the work begins. Past-due amounts may accrue interest at the maximum rate permitted by Alabama law.

Site access and your responsibilities

By hiring us, you confirm that you:

  • Own the property or are authorized by the owner to have the work done.
  • Have disclosed any underground utilities, irrigation, septic lines, or other buried infrastructure you know about.
  • Will keep pets, children, and uninvolved persons clear of the work area while the crew is on site.
  • Will provide reasonable access for our trucks, chipper, and grinder where the job requires it.

We will call 811 to mark public utility lines before stump grinding where required. Private lines (low-voltage lighting, irrigation, invisible fences) are your responsibility to flag in advance.

Insurance and damage

Clemmons Tree Serviceis fully insured for general liability and workers' compensation. A current certificate of insurance is available on request before work begins.

We plan jobs specifically to avoid damage — rigging exists for that reason. In the rare event something is damaged through our fault, our insurance covers it and we will work with you to make it right. Pre-existing damage, naturally fragile materials, and damage from conditions we couldn't reasonably have known about are excluded.

Limitation of liability

To the maximum extent permitted by Alabama law:

  • Our total liability for any claim arising out of a job is limited to the amount you paid us for that job.
  • We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, diminished property value beyond the cost of the work, or emotional distress.
  • We are not liable for delays caused by weather, utility outages, permitting, or other circumstances outside our control.

Nothing in these Terms limits liability for fraud, willful misconduct, or anything else that cannot be limited by law.

Cancellation and refunds

Either of us may cancel a scheduled job before work begins for any reason. If you cancel after we've arrived on site, we may charge a reasonable trip fee covering travel and mobilization time. If a deposit applies, refunds depend on what work has already been scheduled or staged on your behalf — we'll talk it through plainly if it comes up.

Use of this website

The Site is provided for informational purposes — to describe what we do, where we work, and how to reach us. By using the Site, you agree not to:

  • Use it for anything illegal, harmful, or in violation of these Terms.
  • Attempt to interfere with the Site's operation, security, or availability.
  • Scrape, copy, or republish content from the Site without our written permission.
  • Submit false or misleading information through our contact form.

Intellectual property

All photographs, copy, layouts, branding, and other content on the Site are owned by Clemmons Tree Service or used with permission and are protected by U.S. copyright and trademark laws. You may share links to our pages and quote brief excerpts with credit; you may not reproduce the site or its content for commercial purposes without our written permission.

Third-party links

The Site links to third-party services we use or are present on, including our Facebook page. We are not responsible for the content or practices of third-party sites. Your use of those services is subject to their own terms.

Privacy

Information you share with us through the Site or by phone, text, or email is handled according to our Privacy Policy, which is part of these Terms by reference.

Governing law and disputes

These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or our work will be resolved in the state or federal courts located in Cullman County, Alabama, and you consent to the personal jurisdiction of those courts. We'd rather work things out directly before it gets there — call us first.

Changes to these Terms

We may update these Terms when our services or the law change. When we do, we'll update the "Last updated" date above. Material changes will be flagged on this page. Continued use of the Site or our services after an update constitutes acceptance of the revised Terms.
